Amounts Due. Once the applicant is approved and the holding deposit has been paid, Hilltop Management will make arrangements with the applicant to review all the necessary documents and set a day of occupancy. The day of occupancy may not be the actual day you move in, but the day the unit will be available and ready for occupancy. If the applicant is unable to view the property prior to the day of occupancy and refuses to sign the rental agreement, pay the remaining required funds and take occupancy, the applicant will forfeit the holding deposit on a prorata basis for days the property has been held off the market. When all funds are received and the documents signed you now will be referred to as a tenant or Lessee.
Rents Due. All rents are due on the first day of each month. A full 30 days rent will be due prior to or the day of occupancy. If the day of occupancy is not on the first day of the month, the second month's rent will be prorated. Example Only: Day of occupancy is on the 10th of the month, applicant pays a full months rent, the next months rent is due on the first and will be prorated for 20 days. Each month thereafter will be due on the first for a full months rent. Just remember rent is always due on the first of each month regardless of the day you move in. Rent is considered late if paid after the 3rd day of each month. Late notices are sent on the 4th and removal proceedings are initiated if the tenant does not make immediate arrangements for rent payment. If you cannot pay your rent by the 3rd day of each month, then don't rent from Hilltop Management.
If a tenant encounters serious difficulties and does not pay rent and does not move, the only recourse is to take legal action. Management will discuss the details with the tenant to make the process less painful for everyone.
Utilities. The tenant will be responsible for transferring the required utilities into the tenants name as of day of occupancy. It will be the responsibility of the tenant to make these arrangements with each utility company. Each utility company has certain requirements and possible deposits. These deposits and requirements are determined by the utility company and not by Management. Failure to transfer the utilities into the tenants name is cause for termination of your rental agreement.
Rental Agreement. Hilltop Management's Rental Agreement are generally on a month to month basis. A month to month Rental Agreement requires a 30 Day Notice To Vacate, (move-out). The Rental Agreement is a 9 page document, which addresses most issues that will be of concern to both you the tenant and management. The Rental Agreement has approximately 4 Addendums, Cleaning Procedures, House Rules, Mold Addendum, and Smoke Detector Addendum. If the Owner has approved a pet, the tenant will sign a Pet Addendum.
Inspection Day of Occupancy. Hilltop Management will conduct a Move-In Inspection with the tenant prior to move-in. A Move-In Inspection will require review by tenant day of occupancy. The move-in inspection will be reviewed, initialed and returned to Management and kept in the tenants file. The Move-In Inspection reviews any problems or deficiencies of the rental property at the commencement of the tenancy and will also help eliminate problems at the end of the tenancy.
End of Tenancy. If your Rental Agreement is on a month to month basis the tenant must give Management written notice to vacate the property. The tenant must provide this notice in writing 30 days prior to the scheduled move-out date. If this written notice is not received by Management 30 days prior to your move-out date you will continue to be responsible for rent due for a full 30 days. The written notice must contain the tenant's intention to move, date of moving, and new forwarding address. An inspection date will be scheduled with Management to conduct the Move-Out Inspection and schedule the carpets to be professionally cleaned. The tenant will be responsible for notifying the utility companies to transfer the utilities into Management's name for the end of your term, this may not be the last day you live in the residence. The end of the term is 30 days from the date Management receives your written notice.
Return of Security Deposit. For additional protection, appropriate security deposits are always collected upon the completion of the rental application. Amount of deposits are based on the monthly rental rate and the credit worthiness of the tenant. Applicants with pets are required to pay an additional deposit which may be non-refundable, if the Owner approves the pet.
All deposits are maintained in a non-interest bearing trust account as required by state real estate regulations until they are either refunded to the tenant upon the successful move-out inspection or are forfeited to cover damages caused by lease violations. A portion of the security deposit will be non-refundable for the professional cleaning of all the carpets in the property. Management will order the carpets to be cleaned as soon as the property becomes vacant. Your security deposit cannot be considered as last month's rent, the tenant will be responsible for paying the last 30 days of rent.
